New Mexico's outside lawyers could collect up to $1.27bn in Meta case

Private plaintiffs' lawyers stand to collect up to $1.27bn from New Mexico if the state's $25bn court win against Meta Platforms this week is upheld, according to a Reuters review of a contract with the state.New Mexico hired Chicago-based law firm DiCello Levitt to represent it in the Meta case, which alleged the tech company duped its users about who had access to their personal data on its Facebook platform.The state's 2025 contract with DiCello Levitt, reviewed by Reuters after a records request, says the firm can ask the judge overseeing the case to award it 20% of the first $50mn of any eventual recovery, 15% of the next $50mn, 10% of the next $150mn and 5% of any amounts over $250mn.New Mexico and other states have turned to private law firms in a growing number of cases against major technology companies to buttress their legal teams against deep-pocketed defendants. The outside lawyers typically don't charge by the hour but are entitled to a cut of any winnings.In the Meta case, a jury sided with the state in September, and a judge on Wednesday ordered the company to pay $25bn. Meta denied wrongdoing and said it will appeal. Legal experts including Villanova University law professor Peter Ormerod told Reuters this week that the company has a strong basis for arguing that the judgment should be reduced.If New Mexico ultimately recovers $25bn from Meta, DiCello Levitt's fees could reach $1.27bn under the law firm's contract. The amount would come out of the funds Meta pays to New Mexico.To be sure, Meta could win its appeal or the judgment could be trimmed, and the court is not obligated to award the firm the maximum fees allowed under its contract.DiCello Levitt declined to comment about its fees. New Mexico's lead lawyer at the firm, Corban Rhodes, in a statement called the court's decision a "defining moment for consumer protection and privacy."Randi McGinn, a New Mexico lawyer who worked with the DiCello firm in representing the state, told Reuters her small Albuquerque firm is entitled to collect about 33% of its fees. DiCello's contract allowed the firm to designate other lawyers as subcontractors.McGinn, who delivered the state's opening statement and closing argument, cautioned that a final outcome in the case could take several years."People will say it’s a lot of money. But the truth is, we won’t see any of that money unless we win an appeal,” McGinn said.Contingency fee awards over $1bn are exceedingly rare, said Fordham University law professor Howard Erichson. While New Mexico's contract caps fees for DiCello Levitt near 5%, "the sheer size of the recovery means it could result in a massive fee here, so I would expect the court to examine it carefully," Erichson said.The New Mexico attorney general's office and a Meta spokesperson did not immediately respond to requests for comment about the legal fees.Some companies and business groups say that giving private lawyers a stake in state enforcement actions can put lawyers' financial interests in conflict with public policy concerns. Defenders of the practice counter that it helps level the playing field for states going up against companies that can afford armies of lawyers.The rewards can be substantial. Norton Rose Fulbright is set to receive more than $156mn in legal fees for representing Texas in a consumer privacy case that Google settled for $1.375bn. Law firms Keller Postman and McKool Smith billed Texas $142.6mn in a consumer privacy lawsuit against Meta that led to a $1.4bn settlement in 2024.DiCello Levitt's contract mirrors one between New Mexico and Motley Rice for a separate lawsuit alleging Meta fostered social media addiction and other harms on its platforms. Meta denies the claims.Motley Rice could seek up to $67.1mn in that case if appeals courts uphold a pair of rulings totaling $942mn against Meta.Wednesday’s ruling came in a case New Mexico filed in 2021 against Meta after disclosures that British political consulting firm Cambridge Analytica obtained data from as many as 87mn Facebook users without their consent. The now-defunct Cambridge Analytica used the data for voter profiling and targeting.

The role of data protection guardian in personal data

The primary reason for issuing the Personal Data Protection Law worldwide, is the protection of the personal data of each person within the jurisdiction. Allah The Almighty, gave “persons” very special position and high rank at the top of all creatures and based on this “specialty” we must give each person full respect in all aspects including his material property and likewise all his personal data and related info. In the issued personal data protection law, “personal data” covers any information in any form concerning an individual, or an individual who can, directly or indirectly, be identified by reference to his personal identification number, by reference to factors specific to his physical, physiological, intellectual, cultural, economic, or social identity. Moreover, special attention is given to “sensitive personal data” which covers any personal information about an individual’s race, ethnical origin, political or philosophical opinions, religious beliefs, affiliation to union, personal criminal record, or any information in relation to his health or sexual status.The basic rule in the personal data law provides that, personal data shall not be processed without the approval of such person. In this context, “processing of the data” means, any operation or set of operations which is performed upon personal data including collecting, recording, organizing, classifying into groups, storing, adapting, altering, retrieving, using, disclosing by transmission, dissemination, transference or making available for others, or combining, blocking, erasing or destructing data.It is very important to say that, the personal data protection law, refers to many designations including the role of each one, they include, the “Data Controller”, the “Data processor”, the “Data Protection Guardian”, the “Third party” as explained, and the “Data Recipient”.The role of the data protection guardian, is very essential in the process and the proper implementation and full accurate compliance of the personal data protection law. As per the law, the “data protection guardian” is responsible for many duties including: assisting the data controller in exercising his rights and adhering to his duties under the provisions of the law, liaising between the “authority” and the data controller with respect to data controller’s implementation of specific provisions related to the processing of personal data, ensuring that the “data controller” processes personal data in compliance with the provisions of the law, and in the event of the “personal data guardian” identifying any violation regarding this matter, to notify the “authority” upon obtaining new evidence concerning the violations which the data controller has not rectified nor eliminated its causes, after his notification, to maintain a register of the processing which the data controller is obliged to notify the “authority” about. The “data protection guardian” shall provide the “authority” with an updated version of the register once every month and what is very important is the law expressly provides that the “data protection guardian” shall perform his duties independently and impartially.The above duties conferred on the “data protection guardian” clearly shows the important role to be undertaken by him in full independence and impartiality. This makes his role very essential and qualified without any interference from the management of the company concerned or the institution. The impartiality, of course, gives credit to the role the of data protection guardian who take his role within such jurisdiction. We say that, it would be perfect if such “personal data guardian” is out-sourced and undertaken by a qualified person recruited from outside the company or the institution. To give the full view about his role, we need to mention that, the “personal data guardian” works under the supervision of the Minister of Justice or any other minister designated pursuant to a decree and the designated authority which is the “Personal Data Protection Authority”, as per the powers explained in the law. Full personal data protection is essential and the personal data guardian shall put things in order in absolute compliance with the law.Dr AbdelGadir Warsama Ghalib is a corporate legal counsel.
