The Department of Justice (DoJ) will determine within the week the fate of Rodel Jayme, who admitted creating the website where the “Bikoy” videos were uploaded.
The department is set to issue a resolution that will decide whether the National Prosecution Service would file charges of inciting to sedition against Jayme in court.
The prosecutors shall determine if there is probable cause to indict Jayme with inciting to sedition or downgrade the crime to cyberlibel or order a formal preliminary investigation into the case.
Jayme underwent inquest proceedings because he was arrested without a warrant.
Sources said the DoJ wanted to determine if he could also be charged with cybercrime or cyberlibel or violation of Republic Act 7610 or the “Anti Child Abuse Law.”
This is because in one of the videos that went viral, Veronica “Kitty” Duterte, about President Rodrigo Duterte’s youngest daughter, was also linked to the illegal drug trade.
Once the DoJ sees probable cause against Jayme, a complaint against him would be filed before the Parañaque Regional Trial Court.
State Prosecutor Ana Noreen Devanadera was tasked to study the case.
Sen. Antonio Trillanes 4th, who has been linked to the uploading of the “Ang Totoong Narcolist “videos that linked the president’s family to the illegal drug trade, denied any involvement in the uploading of the videos.
“Categorically, we have nothing to do with Rodel Jayme in the making of the Bikoy videos,” Trillanes said.
He pointed out that in President Duterte’s matrix, he and his group were not involved.
“We were not in Duterte’s matrix,” he said. “When Jayme was interviewed, he said he knew nobody from Magdalo,” the senator said. Trillanes urged the National Bureau of Investigation and the DoJ to thoroughly investigate the case.
Meanwhile, Sen. Panfilo “Ping” Lacson said Bikoy, the masked man who appeared in the narcolist video, should surface.
“Bikoy should surface if he has documents or evidence, he should show it for clarity,” he said.
“If he can present evidence, we can recommend at our level in the Senate by way of a committee report, to file a case even if he or she is a member of the first family. But there must be a basis for that, there’s a basis under the law,” the senator added.
