The seventy-first session of the UN International Law Commission kicked off in Geneva Monday with the participation of Qatar's Attorney-General HE Dr. Ali bin Fetais Al Marri as member of the Commission.
The first session of the Commission discussed a number of topics, including those relating to the sixth report on the immunity of State officials from foreign criminal jurisdiction, which is one of the most complex issues in terms of the exercise of jurisdiction in States with limited jurisdiction and questions relating to the application of the principles of the exercise of extraterritorial jurisdiction, in addition to exercise of jurisdiction by the International Court of Justice.
The session also discussed the difficulties faced by States in collecting evidence across national borders to examine custody, extradition or judicial assistance, which has become more complex in view of the immunity enjoyed by officials of foreign States under international law, and reaching a balance between the protection of the immunity of officials of foreign States and the need to combat impunity, where there are still many difficulties to reach a unified agreement despite the great efforts exerted by States and the General Assembly of the United Nations.
During the discussions, the participants explored the best ways to develop broad guidelines and recommendations for making progress in the development of international law.
The session was attended by HE Permanent Representative of the State of Qatar to the United Nations Office in Geneva Ali Khalfan Al Mansouri.
