The primary reason for issuing the Personal Data Protection Law worldwide, is the protection of the personal data of each person within the jurisdiction. Allah The Almighty, gave “persons” very special position and high rank at the top of all creatures and based on this “specialty” we must give each person full respect in all aspects including his material property and likewise all his personal data and related info. In the issued personal data protection law, “personal data” covers any information in any form concerning an individual, or an individual who can, directly or indirectly, be identified by reference to his personal identification number, by reference to factors specific to his physical, physiological, intellectual, cultural, economic, or social identity. Moreover, special attention is given to “sensitive personal data” which covers any personal information about an individual’s race, ethnical origin, political or philosophical opinions, religious beliefs, affiliation to union, personal criminal record, or any information in relation to his health or sexual status.The basic rule in the personal data law provides that, personal data shall not be processed without the approval of such person. In this context, “processing of the data” means, any operation or set of operations which is performed upon personal data including collecting, recording, organizing, classifying into groups, storing, adapting, altering, retrieving, using, disclosing by transmission, dissemination, transference or making available for others, or combining, blocking, erasing or destructing data.It is very important to say that, the personal data protection law, refers to many designations including the role of each one, they include, the “Data Controller”, the “Data processor”, the “Data Protection Guardian”, the “Third party” as explained, and the “Data Recipient”.The role of the data protection guardian, is very essential in the process and the proper implementation and full accurate compliance of the personal data protection law. As per the law, the “data protection guardian” is responsible for many duties including: assisting the data controller in exercising his rights and adhering to his duties under the provisions of the law, liaising between the “authority” and the data controller with respect to data controller’s implementation of specific provisions related to the processing of personal data, ensuring that the “data controller” processes personal data in compliance with the provisions of the law, and in the event of the “personal data guardian” identifying any violation regarding this matter, to notify the “authority” upon obtaining new evidence concerning the violations which the data controller has not rectified nor eliminated its causes, after his notification, to maintain a register of the processing which the data controller is obliged to notify the “authority” about. The “data protection guardian” shall provide the “authority” with an updated version of the register once every month and what is very important is the law expressly provides that the “data protection guardian” shall perform his duties independently and impartially.The above duties conferred on the “data protection guardian” clearly shows the important role to be undertaken by him in full independence and impartiality. This makes his role very essential and qualified without any interference from the management of the company concerned or the institution. The impartiality, of course, gives credit to the role the of data protection guardian who take his role within such jurisdiction. We say that, it would be perfect if such “personal data guardian” is out-sourced and undertaken by a qualified person recruited from outside the company or the institution. To give the full view about his role, we need to mention that, the “personal data guardian” works under the supervision of the Minister of Justice or any other minister designated pursuant to a decree and the designated authority which is the “Personal Data Protection Authority”, as per the powers explained in the law. Full personal data protection is essential and the personal data guardian shall put things in order in absolute compliance with the law.Dr AbdelGadir Warsama Ghalib is a corporate legal counsel.
