Man accused of murder says sorry to have possessed gun

A month after the shooting of Tamworth policeman David Rixon, the man accused of his murder was recorded saying that he wished that he didn’t have the gun.

‘’I wish I hadn’t have had the gun’’, a court has heard.

Michael Allan Jacobs has pleaded not guilty to the murder of Senior Constable Rixon on March 2 last year, when the officer pulled him over for a random breath test, Sydney Morning Herald reported.

The jury has heard Senior Constable Rixon fired four shots that day, three of which hit Jacobs.

Resuming his opening address in the NSW Supreme Court on Friday, crown prosecutor Patrick Barrett said conversations that Jacobs had with his girlfriend, while he was recovering in hospital, were recorded by police and would be played to the jury.

‘’(Jacobs) said ‘I wish I hadn’t have had the gun…’,’’ Barrett said.
